The 11th Circuit Court of Appeals considered’s request to challenge Judge Cannon’s judgment that dismissed the case including classified documents against President Trump.

The appeals court provided a schedule that needs Trump and Jack Smith to file briefs through October, Politico reported.

Jack Smith’s opportunities of restoring the case will not happen before the election after all the legal briefs are filed and the court hears oral arguments.

Special counsel Jack Smith’s bid to restore the phony classified documents case against Donald Trump appears not likely to be dealt with and even argued in court before Election Day.

Trump is objecting to the ruling made by U.S. District Judge Aileen Cannon, which dismissed the case alleging that Trump incorrectly maintained classified national security documents at his Mar-a-Lago estate following his departure from office. The 11th Circuit Court, based in Atlanta, which will examine the appeal, has established a his lawyers to send written arguments by mid-October.

After all the briefs are in, the court will likely hear oral arguments, with a decision weeks or potentially months after that.

On Wednesday, Special Counsel Jack Smith filed an appeal with the 11th Circuit Court of Appeals challenging’s ruling to dismiss the case including classified files.

In a decision handed down on Monday, Judge Aileen Cannon ruled in favor of dismissing the case brought by special counsel Jack Smith, mentioning issues over the legitimacy of his appointment and the appropriation of funds to support his investigation into classified files.

All the allegations against Trump and his co-accused Walt Nauta and Carlos De Oliveira were dismissed.

In June 2023, Jack Smith brought a 37-count federal indictment against Trump in a Miami court, declaring misdeed related to the storage of presidential records at his Mar-a-Lago estate, which was protected by Secret Service personnel.

“The bottom line is this: The Appointments Clause is an important constitutional constraint coming from the separation of powers, and it offers to Congress a thought about role in determining the propriety of vesting appointment power for inferior officers,” the judge wrote in a 93-page filing.

“The Special Counsel’s position successfully takes over that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers,” Cannon composed.I look forward to Trump awarding the next Supreme Court vacancy to this stalwart defender of the Constitution.
