Special counsel Jack Smith was dealt another blow Tuesday in his ongoing effort to quash previous President Donald Trump’s freedom of speech in the face of Democratic warfare being waged against him in the courts.

U.S. District Judge Aileen Cannon, in the Southern District of Florida, rejected Smith’s demand that Trump be silenced with a gag order to prevent Trump from speaking out against the Biden administration’s approval for the FBI to utilize lethal force if needed when it robbed Trump’s Mar-a-Lago Club home in Palm Beach in August of 2022.

Smith’s workplace submitted a motion on Friday to prevent Trump from slamming Biden for supplying the FBI with the legal authority to perform actions that Trump deemed “unthinkable.

“BIDEN’S DOJ WAS AUTHORIZED TO SHOOT ME!,” Trump wrote in a email, according to a New York Times report Wednesday. However, Cannon denied Smith’s motion, adding that “the Special Counsel’s pro forma ‘conferral’ is completely lacking in substance and expert courtesy,” The Hill reported.

Both parties in the event are required to consult each other before submitting motions with the court, according to The Hill.

Smith’s group did not do so until sending an e-mail to Trump attorneys at 5:30 p.m. on Friday, the day before a holiday weekend, The Hill reported.

Smith had required that Cannon rule that Trump “might not make statements that posture a significant, imminent, and foreseeable threat to law enforcement agents.

Cannon realized the request lacked merit and broke the rules concerning permitting appropriate time and consulting with the defense team.

Cannon rejected Smith’s request based on its merits and reprimanded Smith for the prosecution group’s failure to follow proper procedures.

Cannon highlighted the value of providing adequate time for a of the relief asked for by the opposing counsel before reaching a choice.

Cannon also wrote guidelines to force Smith’s team to confer with Trump attorneys before submitting future motions, saying that “Failure to comply with these requirements might lead to sanctions.

Trump’s legal group likewise filed a motion over the Memorial Day weekend blasting Smith’s gag order request and calling Smith’s demand to quash the previous president’s freedom of speech an “amazing, unprecedented, and unconstitutional censorship application,” CNN reported.

Trump’s legal team also declared that Smith, whom they labeled a “self-proclaimed enforcer of woke, commis Leftist ideas,” was trying to limit President Trump’s freedom based on whether he stuck to Smith’s specific political beliefs.

This is not the very first time that Smith has looked to slap Trump with a gag order. Smith acquired a partial gag order against Trump about the election interference case Smith brought against the previous president in Washington, D.C.

According to The New York Times, that order was approved by the U.S. District Court of Appeals for the District of Columbia.

As it reaches its conclusion, Trump is limited from speaking publicly about his “hush” trial in Manhattan.
